Information from the Hague Conference  “On 19 January 2017, the Republic of Guatemala deposited its instrument of accession to the Hague Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (the “Apostille Convention”), making it the 113thContracting State to the Convention. Following the usual procedural steps, the Convention will enter into force for Guatemala on 18 September 2017.

At the ceremony, which took place at the Ministry of Foreign Affairs of the Netherlands (i.e. the Depositary), H.E. Mr Luis Raúl Estévez López, Ambassador of the Republic of Guatemala, and Ms Celeste Marinelli Block, Counsellor, represented the Embassy of Guatemala. On behalf of the Depositary, Head of the Publication, Treaties Division, Mr Jules van Eijndhoven and Senior Legal Officer Mr Mark Groen also attended the ceremony. Secretary General Mr Christophe Bernasconi and Principal Legal Officer Ms Mayela Celis represented the Permanent Bureau of the Hague Conference on Private International Law (HCCH). 

While not a Member State of the Hague Conference, the Republic of Guatemala is now a Contracting State to three Hague Conventions, the other two being the Convention of 25 October 1980 on the Civil Aspects of International Child Abduction and the Convention of 29 May 1993 on Protection of Children and Co-operation in Respect of Intercountry Adoption.

Pursuant to Article 12 of the Apostille Convention the Depositary shall give notice to the Contracting States of the accession of Guatemala. Hague Conference.

What is an Apostille? An Apostille is a certification provided in the United States since 1981 that complies with the 1961 Hague Convention.

What is the object of an Apostille? What is an Apostille for? An Apostille abolishes the requirement of  consular legalization for foreign public documents.

Who provides Apostilles? Each subscribing nation may designate those authorities which may provide Apostilles for their jurisdiction. See below to order an Apostille.

How do you pronounce Apostille?   U.S. Apostille offices pronounce it “ă pŏs tēēl”

What other name has the Apostille?  It is also known as Authentication Certificate.  Apostille is also a French word which means a certification and in English it is used  to refer to the legalization of a document for international use under the terms of the 1961 Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents.

What does an Apostille do? It certifies the authenticity of the signature, identifies the seal which the document bears and the capacity in which the person signing the document has acted.

What is the Apostille format?  Every Apostille shows 10 items besides the title and a note displaying Convention de La Haye du 5 Octobre 1961.

What is the new Apostille seal?  Depending on the country there is/was a golden seal, red stamp, etc, depending on the country/state issuing the apostille.

Is still the golden Apostille seal current?  As of January 2017 in the state of California the golden seal is no longer used.

Why do I have to use an Apostille? It authenticates seals and signatures so that they can be recognized in foreign countries that are parties to the Convention.

What countries require an Apostille?  Foreign countries where you will send your documents. (See the current countries members of the Hague Convention document legalization as of Jan 2017) will accept documents and recognize them as legal according to the Hague Convention.

What is an Apostille for? To legalize documents to be used in foreign countries.

When I have to use an embassy legalization instead of an Apostille?  Those countries that did not sign the Hague convention agreement on legalization do not recognize Apostilles so you need to bring the document(s) to your nearest consulate for legalization.  Some of them requires an Apostille from the state, then from the US Department of State before your submit them to the embassy. Always check their requirements.

Who needs an Apostille?  Any person that needs to ship documents to a country member of the Hague Convention.

Where is the Apostille seal placed? Half of the seal is on the Apostille certification page and the other half on the state certificate or notarial act page.

California Apostille format includes the information of who signed the certificate(state official or notary) and the Apostille itself; date, number where you can verify at the Secretary of State website its validity, etc.

How can you verify if an Apostille was issued by a Secretary of State?  The Apostille Verification at the SOS site allows you to verify online, whether an Authentication Certificate (Apostille) was issued by the California Secretary of State’s office.

When a loved one passes away, his or her estate often goes through a court-managed process called probate or estate administration where the assets of the deceased are managed and distributed.  If your loved-one owned his or her assets through a well drafted and properly funded living trust, it is likely that no court-managed administration is necessary, though the successor trustee needs to administer the distribution of the deceased’s assets.  The length of time needed to complete the probate of an estate depends on the size and complexity of the estate and the local rules and schedule of the probate court.

Every probate estate is unique, but most involve the following steps:

  • Filing of a petition with the proper probate court.
  • Notice to heirs under the Will or to statutory heirs (if no Will exists).
  • Petition to appoint Executor (in the case of a Will) or Administrator for the estate.
  • Inventory and appraisal of estate assets by Executor/Administrator.
  • Payment of estate debt to rightful creditors.
  • Sale of estate assets.
  • Payment of estate taxes, if applicable.
  • Final distribution of assets to heirs.


What happens if someone objects to the Will?

An objection to a Will, also known as a “Will contest” is a fairly common occurrence during the probate proceedings and can be incredibly costly to litigate.

In order to contest a Will, one has to have legal “standing” to raise objections.  This usually occurs when, for example, children are to receive disproportionate shares under the Will, or when distribution schemes change from a prior Will to a later Will.  In addition to disputes over the tangible distributions, Will contests can be a quarrel over the person designated to serve as Executor.

Does probate administer all property of the deceased?

Probate is primarily a process through which title is transferred from the name of the deceased to the names of the beneficiaries.

Certain types of assets are what is called “non-probate assets” do not go through probate.  These include:

  • Property in which you own title as “joint tenants with right of survivorship”.  Such property passes to the co-owners by operation of law and do not go through probate.
  • Retirement accounts such as IRA and 401(k) accounts where there are designated beneficiaries.
  • Life insurance policies.
  • Bank accounts with “pay on death” (POD) designations or “in trust for” designations.
  • Property owned by a living trust.  Legal title to such property passes to successor trustees without having to go through probate.

Do I get paid for serving as an Executor?

Executors are reimbursed for all legitimate out-of-pocket expenses incurred in the process of management and distribution of the deceased estate.  In addition, you may be entitled to statutory fees, which vary from location to location and on the size of the probate estate.  The Executor has to fulfill his or her fiduciary duties on behalf of the estate with the highest degree of integrity and can be held liable for mismanagement of estate assets in his or her care.  It is advised that the Executor retain an attorney and an accountant to advise and assist him with his or her duties.

How much does probate cost?  How long does it take?

The cost and duration of probate can vary substantially depending on a number of factors such as the value and complexity of the estate, the existence of a Will and the location of real property owned by the estate.  Will contests or disputes with alleged creditors over the debts of the estate can also add significant cost and delay.  Common expenses of an estate include executors fees, attorneys’ fees, accounting fees, court fees, appraisal costs, and surety bonds.  These typically add up to 4-8% of the total estate value. Most estates are settled though probate in about 18 to 24 months, assuming there is no litigation involved.

  The AB 2217, proposed by David Hadley, would increase the maximum fees Notaries could charge for Acknowledgments and Jurats from $10 to $15




Steve Fazio, a Republican candidate for California’s 27th Senate District  has come out in support of allowing California Notaries to charge higher fees for their services because of the important role they play in fighting fraud



There are diverse opinions about the subject.   Ask questions, follow the money, who benefit the most and maybe you will have a decent answer to this proposal.  Read notary forums; this is an extract of one comment:

While we’re like a bunch of hens scratching piecemeal for crumbs in the signing field, we have witnessed the emergence of XYZ making millions of $$ off our backs after convincing the lenders we all needed routine background checks, testing, certification, and other baloney as a result of the CFPB, but did anybody see that coming? Did anybody see Snapdocs coming? Did anybody see the latest permutation of the coffee site coming? What else has some genius cooked up to get their very lucrative piece of the pie as the signing agent profession continues to morph before our very eyes and which we had no inkling of until it landed in our lap? Might be the very guys behind this fee increase.

The Notary fee is paid when a client goes to an office where the Notary offers her/his service.   Mobile Notaries charge additional fees based on time involved, printing and car expense, company will not pay/risks, type of notarization, travel fees, time of the day or the month when notarize loan packages.

Background Check

Some of my clients ask me to translate, certify, notarize and get an Apostille for a specific country. It is a requirement from the process in their country of destination. What some of them do not know is how to get one. “How can I get a criminal background check?”
There are several companies available.
One of them is Direct Screening.   If you are a Notary Public, you can get information at NNA.

Once I receive the scanned copy, I can start the translation; by the time I receive the original, the translation is certified, notarized and ready for an Apostille with the original.

I have been in the real estate business for more than 25 years and am a Life Member in the Masters Club Top 10%. I hold a State leadership position in the CA Women’s Council of Realtors. I currently am a Director of our Sacramento Association of Realtors. I have a Bachelor of Science degree in Business from the University of San Francisco.
